The first step is always to build a case by collecting and evaluating all of the evidence that can help you secure a fair and reasonable settlement. While the goal of this action is to prepare as if you are going to trial, there are benefits to settling a case. Settling a case avoids the risk of trial, which can be expensive and potentially fruitless. You also avoid further emotional pain, not having to “re-live” the emotional toll by achieving a final resolution and gaining peace of mind. The disadvantage of settling is that you don’t know what a jury would have decided, which may have been more or less than the settlement amount.
